Anywair Radiocasting — Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the Anywair Radiocasting website, applications, and related services (the "Platform" or "Services").

By accessing or using the Platform, you agree to be legally bound by these Terms. If you do not agree, you must not use the Platform.

1. About Anywair Radiocasting

Anywair Radiocasting ("Anywair", "we", "us", "our") is a digital radio and audio broadcasting platform that allows users to create, host, stream, and interact with live and recorded audio content, including music, talk shows, and interactive features.

2. Eligibility

You must be at least 18 years old to create an account or operate a station on Anywair. By using the Platform, you warrant that you have the legal capacity to enter into these Terms.

3. Accounts & Responsibility

You are responsible for:

  • All activity conducted through your account
  • Maintaining the confidentiality of your login details
  • Ensuring all content streamed or uploaded via your account complies with these Terms and all applicable laws

Anywair is not responsible for unauthorised use of your account.

4. User Content & Broadcasting Licences (CRITICAL)

4.1 Licence Responsibility

You solely represent and warrant that you hold all necessary rights, licences, consents, and permissions required to:

  • Broadcast music
  • Stream sound recordings
  • Perform musical works
  • Distribute live or recorded audio
  • Use any copyrighted material

This includes (but is not limited to) licences from:

  • APRA AMCOS
  • PPCA
  • Any international or local rights organisations relevant to your broadcast

Anywair does NOT obtain licences on your behalf unless explicitly stated in writing.

4.2 Non-Compliance With Licensing Requirements

If Anywair reasonably believes that you:

  • Do not hold appropriate licences,
  • Are broadcasting or streaming content without required permissions,
  • Have provided inaccurate or misleading information regarding licensing, or
  • Are otherwise in breach of copyright or broadcasting laws,

Anywair may, at its discretion, take one or more of the following actions:

  • Temporarily suspend your station or broadcast
  • Remove or restrict access to specific content
  • Request evidence of licensing or compliance
  • Permanently remove your station or terminate your account in cases of serious or repeated non-compliance

Where appropriate, Anywair may provide notice or an opportunity to address the issue; however, Anywair is not required to do so, particularly where immediate action is necessary to reduce legal, regulatory, or platform risk.

4.3 Proof of Licensing

Anywair may request evidence of licensing at any time. Failure to provide satisfactory proof may result in immediate removal.

5. Live Content & Moderation

5.1 No Pre-Moderation

Live broadcasts are not pre-moderated. Content is the sole responsibility of the broadcaster.

5.2 Right to Cut Streams

Anywair reserves the absolute right to:

  • Interrupt or terminate any live broadcast
  • Remove content
  • Disable features or stations

At any time, for any reason, including risk, complaints, legal exposure, or platform integrity.

5.3 Prohibited Content

You must not broadcast or upload content that:

  • Is defamatory, abusive, or threatening
  • Contains hate speech or harassment
  • Promotes violence, illegal activity, or misinformation
  • Infringes intellectual property rights
  • Breaches broadcasting or consumer laws

6. Interactive & Competitive Features

Anywair may offer features such as:

  • Voting
  • DJ battles
  • Rankings
  • Listener interaction

You agree not to:

  • Manipulate votes
  • Harass or target broadcasters
  • Use automated systems or fake accounts
  • Misrepresent competitions or outcomes

Anywair may modify, suspend, or remove these features at any time.

7. Intellectual Property

All platform software, branding, logos, and design elements are owned by Anywair or its licensors.

You may not copy, modify, distribute, or exploit Anywair intellectual property without prior written permission.

8. Your Content Licence to Anywair

You retain ownership of your content.

By uploading or streaming content, you grant Anywair a worldwide, non-exclusive, royalty-free licence to host, transmit, reproduce, and distribute that content solely for operating and promoting the Platform.

9. Indemnity (VERY IMPORTANT)

You agree to indemnify, defend, and hold harmless Anywair, its directors, employees, and partners from all claims, damages, losses, costs, and legal fees arising from:

  • Your content
  • Your broadcasts
  • Your failure to obtain licences
  • Any breach of these Terms
  • Any legal action by copyright holders or regulators

10. Termination

Anywair may:

  • Suspend or terminate your account
  • Remove your station or content
  • Restrict access

At any time, with or without notice, particularly for legal, licensing, or compliance reasons.

You may terminate your account at any time, but termination does not remove liability for prior breaches.

11. Disclaimers

The Platform is provided "as is" and "as available".

We do not guarantee uninterrupted service, availability, or error-free operation.

12. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees under the Australian Consumer Law that cannot be excluded by law.

13. Limitation of Liability

To the maximum extent permitted by law, Anywair is not liable for:

  • Loss of revenue
  • Loss of data
  • Reputational damage
  • Indirect or consequential losses

14. Changes to These Terms

We may update these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of Australia, and the courts of that jurisdiction have exclusive authority.
